Welcome to All My Cozy Creatures (“AMCC,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the All My Cozy Creatures website, online store, products, content, and related services (collectively, the “Services”).

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

By visiting our website, browsing our products, placing an order, or otherwise using our Services, you agree to these Terms and to any policies referenced in them, including our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Online Store Terms

By using our Services or placing an order, you represent that you have the legal capacity to enter into a binding agreement in your jurisdiction.

If you are under the age of majority where you live, the Services should be used only with the involvement of a parent or legal guardian where required.

You may not use our Services or products for any illegal, fraudulent, abusive, or unauthorized purpose.

You may not interfere with the operation or security of our website or attempt to gain unauthorized access to our systems, accounts, networks, or other users' information.

2. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, colors, features, pricing, and availability.

However:

Colors may appear somewhat different depending on your screen or device.
Product measurements may vary slightly because of manufacturing or supplier tolerances.
Packaging or minor product details may change.
Product appearances may vary slightly from photographs.
Supplier specifications may occasionally change.

For size-dependent products, customers are responsible for reviewing measurements, fit guidance, and product descriptions before ordering.

Please contact us before purchasing if you have questions about whether a product may be appropriate for your pet.

Shopify requires merchants' product and performance claims to be accurate and not misleading, so I would retain this kind of measured wording instead of making absolute claims about quality, durability, popularity, or safety unless they can be substantiated.

3. Pet Product Suitability and Use

Every animal is different.

Customers are responsible for determining whether a product is appropriate for their particular pet, taking into consideration factors such as:

Species
Size and weight
Age
Health and mobility
Temperament
Chewing or scratching behavior
Strength
Activity level
Intended use
Environment

Products sold by All My Cozy Creatures are intended for the purposes described on the applicable product page.

Unless expressly stated otherwise, our products are not intended to diagnose, treat, cure, or prevent a medical condition, and information provided through our store is not veterinary, medical, or behavioral advice.

Always follow applicable product instructions.

Supervise pets when appropriate, inspect products regularly, and discontinue use immediately if a product becomes damaged, worn, broken, unstable, unsafe, or unsuitable for your animal.

Products containing small parts, cords, straps, stuffing, fasteners, or other components should be used with particular care around animals that chew or ingest non-food items.

4. Reptile Products

Reptile husbandry requirements can vary significantly by species and individual animal.

Before using a reptile product, customers are responsible for confirming that it is appropriate for their animal's:

Size
Enclosure
Temperature requirements
Heating setup
Lighting requirements
Humidity requirements
Substrate and habitat
Other husbandry needs

General product information provided by AMCC should not replace species-specific husbandry guidance from a qualified veterinarian or other appropriately knowledgeable professional.

5. Pet Travel, Carrier, and Vehicle Products

Travel products, carriers, pet seats, containment accessories, straps, and similar products should be used only as described on the applicable product page and according to any provided instructions.

Unless a product page specifically states that verified formal crash testing or another safety certification has been completed, the product should not be considered or represented as a crash-tested vehicle safety restraint.

Customers are responsible for:

Confirming that the product is appropriately sized for their pet
Properly installing or securing the product
Inspecting straps, stitching, clips, zippers, fasteners, and attachment points before use
Supervising their pet when appropriate
Following applicable vehicle and animal-transport laws

Do not use a travel or containment product for a pet that exceeds its stated size or weight capacity or for an animal whose behavior makes the product unsafe.

This section is particularly worthwhile for AMCC because it keeps the Terms consistent with the careful safety disclaimer you're already using on the Cozy Car Ride Pet Seat.

6. Prices

Unless otherwise stated, prices are displayed in U.S. dollars.

We may change prices, promotions, product offerings, or availability from time to time.

The price applicable to an order is generally the price displayed during checkout when the order is submitted, subject to correction of obvious technical or pricing errors as permitted by applicable law.

Applicable taxes and shipping charges, if any, will be shown during checkout.

7. Promotions and Discount Codes

Promotions, discounts, coupon codes, and special offers may be subject to additional terms, including:

Expiration dates
Minimum purchase amounts
Product exclusions
Customer eligibility requirements
Usage limits
Restrictions on combining promotions

Unless otherwise stated, promotional offers have no cash value.

We reserve the right to modify or discontinue promotions where permitted by law.

8. Orders

Submitting an order does not necessarily mean that we have accepted it.

We may decline, limit, or cancel an order where reasonably necessary, including because of:

Product unavailability
Inventory errors
Pricing or technical errors
Shipping restrictions
Suspected fraud or unauthorized payment activity
Incorrect or incomplete customer information
A violation of these Terms

If we cancel an order after payment has been collected, we will issue an appropriate refund.

When placing an order, you agree to provide current, complete, and accurate information.

We may contact you if additional information is required to process or fulfill your order.

9. Order Changes and Cancellations

We begin processing orders as quickly as possible.

If you need to change or cancel an order, contact us immediately at info@allmycozycreatures.com.

We will make reasonable efforts to accommodate the request, but we cannot guarantee that an order can be changed or canceled after fulfillment has begun.

Once an order has shipped, it generally cannot be canceled and will instead be subject to our Returns & Refunds Policy.

10. Third-Party Fulfillment

All My Cozy Creatures works with third-party suppliers and fulfillment partners.

As a result, some products may be shipped directly by a third-party fulfillment partner from a location other than our California business address.

Products within the same order may be fulfilled from different locations and may arrive in separate packages or on different days.

Shopify expressly tells merchants using dropshipping or third-party fulfillment to disclose this arrangement to customers.

11. Shipping and Delivery

Shipping and delivery timelines are estimates unless expressly stated otherwise.

Please review our Shipping Policy for information regarding processing times, estimated delivery, tracking, multiple shipments, address issues, and delayed packages.

We will communicate material changes or delays as required by applicable law.

Federal rules generally require online sellers to ship within the promised timeframe or, if no shipment timeframe is stated, within 30 days, subject to the applicable rules for obtaining the customer's consent to delays or providing refunds.

12. Returns and Refunds

Returns, exchanges, damaged-item claims, and refunds are governed by our Returns & Refunds Policy.

Please review that policy before purchasing.

Our policies do not limit any rights or remedies that cannot legally be excluded under applicable consumer-protection law.

Shopify expects a store's refund policy to clearly disclose matters including the return period, return destination, return costs, and how customers can seek assistance with a delayed refund.

13. Third-Party Services

Our store is hosted by Shopify and may use third-party companies and services for functions such as:

Payment processing
Order fulfillment
Shipping
Analytics
Advertising
Marketing
Email communications
Fraud prevention
Customer support

Third-party websites, platforms, services, or integrations may be governed by their own terms and privacy policies.

We are not responsible for the independent practices of third parties that we do not control, except to the extent otherwise required by applicable law.

Providing a link does not necessarily mean that AMCC endorses or controls that third party.

If you leave our website and use a third-party site or service, you should review its applicable terms and privacy practices.

15. Intellectual Property

The All My Cozy Creatures name, AMCC branding, original logos, original written content, original graphics, website materials, and other content created or owned by All My Cozy Creatures are protected by applicable intellectual-property laws.

Other product photographs, descriptions, trademarks, or materials may belong to suppliers, licensors, service providers, or other third parties and are used with authorization or as otherwise permitted.

You may not copy, reproduce, republish, distribute, modify, sell, or commercially exploit AMCC-owned content without our prior permission except as permitted by law.

16. Reviews, Feedback, and Communications

If we allow customers to submit reviews, photographs, comments, feedback, suggestions, or other content, you are responsible for ensuring that the material you provide is lawful and that you have the right to provide it.

You may not submit content that infringes another person's intellectual-property, privacy, publicity, or other legal rights.

We may moderate or remove submitted content where permitted by law and consistent with our policies.

17. Prohibited Uses

You may not use the website or Services to:

Violate applicable laws or regulations
Infringe intellectual-property rights
Submit false or misleading information
Transmit malware, viruses, or malicious code
Attempt to obtain unauthorized access to accounts or systems
Scrape or systematically extract website content for unauthorized commercial purposes
Interfere with website security or operation
Engage in fraud or abusive conduct
Harass, threaten, or harm another person
Circumvent security features or access controls

We may restrict access to the Services when we reasonably believe these Terms have been violated.

18. Disclaimer of Warranties

We strive to provide accurate information and quality products.

However, except for warranties expressly provided by us or rights that cannot legally be excluded, the Services and products are provided subject to the warranties and protections required by applicable law.

Nothing in these Terms is intended to waive, disclaim, or limit a consumer right or warranty that cannot lawfully be waived.

I prefer this wording to a sweeping “everything is provided AS IS and without any warranties whatsoever” clause. Consumer-protection rules vary by jurisdiction, and Shopify explicitly reminds merchants that they remain responsible for complying with the consumer laws that apply where they and their customers are located.

19. Limitation of Liability

To the fullest extent permitted by applicable law, All My Cozy Creatures will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services or products.

Without limiting applicable consumer rights, AMCC is not responsible for harm caused by circumstances including:

Using a product contrary to its instructions or intended purpose
Using an incorrectly sized product
Failure to supervise an animal when supervision is appropriate
Failure to inspect or discontinue use of a damaged product
Pet chewing, scratching, tearing, ingestion, escape behavior, or destructive behavior
Unauthorized modification of a product
Use of a product with an animal for whom the product is unsuitable

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

That final sentence is important. I would not use a liability disclaimer that implies AMCC can avoid responsibility for everything, including legally non-waivable obligations or defects for which the law imposes responsibility.

20. Product Safety and Recalls

If we become aware that a product is subject to a recall or other legally required safety action, we may remove it from sale and take other steps required by applicable law.

Customers should discontinue use of a recalled product as directed by the applicable recall notice.

Shopify notes that merchants are responsible for complying with applicable product-recall obligations, including removing recalled products and notifying affected customers when required.

21. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

Please review that policy for information about how personal information is collected, processed, disclosed, and protected and about privacy rights that may apply to you.

22. Governing Law

These Terms are governed by applicable federal law and the laws of the State of California, without regard to conflict-of-law principles, except where another jurisdiction's mandatory consumer-protection laws apply.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary.

The remaining provisions will continue in effect.

24. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

25. Entire Agreement

These Terms, together with the policies and notices referenced in them, constitute the agreement between you and All My Cozy Creatures regarding your use of the Services, except where additional terms expressly apply.
